In case you missed the news out of the Republican Party of Texas convention, conspiring with the chief priests in exchange for 30 pieces of silver to advocate for applying a religious litmus test on anyone seeking to run for elected office did not bode well.

That voice vote on the Chairman of the Republican Party of Texas was the result of the challenger winning only four of the 31 breakout caucus sessions where delegates cast their vote this past Friday morning—and in the face of overwhelming defeat — the challenger conceded the race from the convention floor.

Is the May 24th runoff for Chair of the Harris County Republican Party shaping up to be a rinse & repeat of the State Chair race?

Will those ugly flyers show up in your mailboxes?

As I look back upon the weeks heading into convention I thought the Terry Lowry Religious Litmus Test to fill vacant precinct chair positions would never rear its ugly head again.

Stephen Costello, the Flood Czar

In 2010, Stephen Costello, Annise Parker, Brenda Stardig, and other politicians sold the rain tax as a mechanism to improve drainage and reduce flooding in Houston. On the weekend of April 15, 2016, the city experienced the second catastrophic flood in the last year. Many families in the Meyerland area were just getting back into their newly repaired homes when the Tax Day flood hit our community. Social media and our local media outlets filled our screens with tragic stories and pictures. And, the City of Houston and Mayor Sylvester Turner decided to respond to this tragedy with a surreal gut punch – Stephen Costello will serve as the city’s Flood Czar.

Just when we thought we had said adios to Costello, he returns to fix a problem that he claimed to solve with the rain tax. Costello, et al. led the most disingenuous and fraudulent political campaign ever seen around these parts – and that is saying something. Thankfully, the Texas Supreme Court ruled that the rain tax ballot language was fraudulent.

Remember this guy from the Prop1 campaign?

Houston floods. It always has and always will. Much of Houston’s history is timed by flooding events. Just think about your lifetime. Alicia. Ike. Allison. Memorial Day. Now, Tax Day.

Meteorologists and hydrologists often refer to the one hundred year floodplain, which is a flood event that has a one percent possibility of occurring in any given year. So, why are we experiencing one hundred year flood events with such frequency? There is an answer. Of course, the deceitful rain tax campaign never told you this information.

The Harris County Flood Control District (HCFCD) is a governmental entity and you pay a tax for it. This county agency is responsible for flood mitigation in our area. So, Harris County is responsible for maintaining our streams and bayous NOT the city.

Houston is broken into different watersheds and the study of the different watersheds is key to understanding Houston flooding. The most studied watershed in our region is the Brays watershed. I say this because of the work of Dr. Philip B. Bedient from Rice who sought to correctly identify the watersheds and build an alert system for the Texas Medical Center, which is in the Brays watershed.

The study of a watershed system is a detailed analysis of the drainage system of a particular watershed. The variables of how a watershed system works includes rainfall amounts over the watershed, barriers to drainage, drainage capacity of a system, and saturation.

The idea and thought behind a flood alert system was to give people notice of an impending flood event. The damage done to the Texas Medical Center in Tropical Storm Allison was enormous, think billions. Dr. Bedient had an alert system in place that day; but, because of the newness and the late hour when Tropical Storm Allison overwhelmed the watershed, it was not successful in preventing the massive damage that occurred. Many of the flood gates were left open. While there was a lot of finger pointing by the political and TMC administrative types, the system did work as designed. The system Bedient designed knew that the Texas Medical Center was going to flood before it occurred. Notice of an impending flood can save billions in damage. Dr. Bedient’s revolution was a turning point in our flood history.

His model is now used by Harris County emergency management types to warn and deploy forces when flooding is likely. Dr. Bedient’s work ultimately developed into the Harris County Flood Warning System.

I became interested in Dr. Bedient’s work after Tropical Storm Allison. As the Immediate Past President of the Braeswood Place Homeowners Association, I sought answers and solutions for the over 400 homeowners in Braeswood who experienced flooding during Allison. At that time, I convinced myself that surely an engineering fix was available. Although I was right, I had no idea at the time that the answer was almost incalculable in terms of cost. Neal Meyer wrote about this recently in his post in Blog Houston and was entirely correct.

I remember finding Dr. Bedient’s office and I told him where I lived and my interest. He knew my neighborhood well because of his detailed analysis of the Brays watershed. It was above the Harris Gully where he mounted cameras to actually see the major drainage outlet for the TMC. Dr. Bedient pointed out the barriers we had protecting Braeswood Place. One example is the railroad track that trapped water to our west but flooded Bellaire. Another example is the low bridge on 288, which acts as a dam backing water up into the Texas Medical Center – a design flaw by TxDOT. During the Tax Day flood, 288 flooded again. The flooding generally starts at the bayou and the bridge design flaw shuts down 288 rather quickly during flood events along Brays and cuts off access to the Texas Medical Center from 288. The system where you live will have unique characteristics too.

The most important thing I learned from Dr. Bedient is that the floodplain will change as the watershed is built out. It’s going to rise and flood faster the more impervious surfaces are built in a watershed. I remember Dr. Bedient saying that Brays Bayou itself was built to move the water out for a one hundred year storm assuming 40{997ab4c1e65fa660c64e6dfea23d436a73c89d6254ad3ae72f887cf583448986} of the watershed was built out, which was done in the 1950’s. Now, 95{997ab4c1e65fa660c64e6dfea23d436a73c89d6254ad3ae72f887cf583448986} of the watershed is built out, which means that the base flood elevation is rising and people who once thought they were out of the floodplain are now in it. A calculation is made after each flood and a new determination is made as to the new location of the floodplain; but, this does not mean new flood maps are drawn after each new determination. These are often contentious and political fights. The City of Houston wants people to rebuild in Meyerland and Braeswood Place because there are a lot of property tax dollars from those neighborhoods flowing into city coffers.

The latest flood impacted two new or little known watersheds, Cypress Creek and Little Cypress Creek. Over four inches an hour will overwhelm our watersheds. People who have never experienced flooding before were left wondering how this happened. It happened because the watershed was overwhelmed and the new impervious surface coverage is exasperating the problem. Think about an overflowing bathtub and not draining fast enough.

Many of the homes affected by the rise of Cypress Creek and Little Cypress Creek did not exist ten years ago. The most studied watershed is Brays followed by Buffalo Bayou. Buffalo Bayou was dealt with years ago with the construction of the Barker and Addicks reservoirs. Make no mistake, the flooding would have been disastrous if these two reservoirs did not exist. Both the Addicks and Barker dams do their job and have done so for years.

I always find it interesting how the media and politicians react to flooding. While Stephen Costello is the father of the rain tax, he needed help in this quest. Council Member Brenda Stardig made the motion for the City of Houston enabling legislation for Prop1. Meyerland has seen disastrous flooding twice since Prop1 was created. Many Meyerland residents who flooded in Allison believed Costello’s nonsense. Also, the ballot language was misleading – the Texas Supreme Court concurs. More importantly, Harris County is in charge of flood control. The city, at most, is responsible for water in their streets. It is clear that the rain tax was nothing more than a money grab for contractors and city folks, which is why I and a number of other folks fought hard to stop Prop1. Now, the Prop1 funds are being used for everything but flood control, mostly city salaries.

People need to understand that Costello and his engineering company represent developers and businesses who are building out the watershed. This, of course, is making flooding worse in Meyerland. Costello’s job is to go into city hall and convince city engineers, who may be paid with rain tax funds, that his client’s projects will not cause flooding. So, when you think of Stephen Costello as the Flood Czar, you are looking at the guy who has caused a lot of the flooding problems. To make the point clear, Costello has made a living of not mitigating for his client’s projects. Mitigation is expensive and if you hire the Flood Czar, you get the benefit of his graft and corruption in the city engineering department. The displaced water winds up in the homes in Meyerland or maybe your home if it floods. Costello needs to use his position to advocate for the suspension of the Prop1 tax for all homeowners whose homes have flooded since the rain tax was enacted. I would argue that the city should suspend the property taxes of flood victims altogether until they are back in their homes. When you see the Flood Czar ask him about this.

Pulitzer prize columnist all wet on bathroom ordinances

Americans are, once again, witnessing the “Tyranny of the Minority”.

If you want to see a classic example of how a left leaning major market columnist shifts blame to the hated Republicans on an issue, please read Pulitzer Prize winning Houston Chronicle columnist Lisa Falkenberg’s latest screed. Titled Bathroom policy fast becoming hot-button issue for politicians, Ms. Falkenberg stretches, bends, and breaks the truth in her quest to demonize Republicans.

“The handwriting is on the bathroom wall: Stay out of the ladies’ room if you’re a man,” Republican Lt. Gov. Dan Patrick said a few weeks ago, wading into the national debate. “If it costs me an election, if it costs me a lot of grief, then so be it. If we can’t fight for something this basic, then we’ve lost our country.”

Ain’t he brave?

Well, yeah, in a way he is. He knew before he said those words that people like Ms. Falkenberg would attack, smear, and mock him. But he did it anyway because it was the right thing to do.

I know, I know. It’s a slippery-slope thing. If we allow people the freedom to use the bathroom they deem appropriate, one can only guess what would happen next!

Actually, we don’t have to guess. They’ve been doing it for decades. Without much fanfare. Until it became a handy dog-whistle issue for Republican primary voters. Now it’s the end of civilization.

She’s right. People have been doing it for decades or centuries, who knows? But isn’t that the point? No one knew – therefore, no problem. You dress like a woman, no one pays attention. But that isn’t the issue today, is it? No, the issue today is that people want the right to go into the opposite gender’s restrooms and they want to do it in your face, without regard to the privacy rights of 99.9{997ab4c1e65fa660c64e6dfea23d436a73c89d6254ad3ae72f887cf583448986} of the population as a whole.

Do you see that sentence in bold above? This one:

Until it became a handy dog-whistle issue for Republican primary voters.

That is where Ms. Falkenberg broke the truth. That is a flat out lie. The dog-whistle belongs to the LGBTABCDEFG crowd that insists that we have to “accept” whatever it is they want today. There never would be an issue if the LGBTABCDEFG crowd had not started passing laws saying that men could enter women’s restrooms, locker rooms, showers, spas, etc. No issue at all. Republican voters rightly responded to this nonsense and hopefully will keep on responding to this nonsense.

There’s no evidence that this is a public safety issue.

Another untruth, although this one could be considered an opinion, not a lie. Because there has been plenty of evidence presented that this is in fact a public safety issue. Ms. Falkenberg simply chooses to ignore it to form her opinion.

Now check this out: Ms. Falkenberg is suddenly for local control.

Back to conservative values: I thought local control was one of them.

This week, our lieutenant governor, whose office is based in Austin, called for the ouster of Fort Worth Independent School District Superintendent Kent Scribner because he approved new guidelines to accommodate transgender students in a broad array of areas from dress code to sports.

Patrick said if parents are unhappy with the district’s decision, then it’s up to the school board and superintendent to address it. If they don’t, he said, “that’s why we have elections.” It’s up to parents and school boards to “reflect the values of that school district,” he said.

Well, the Fort Worth district has spoken on its values. And they don’t need some politician in Austin butting in.

Ha, you can’t make this stuff up. Can you imagine the outrage Ms. Falkenberg would have if a local community passed an ordinance saying that no abortions would be performed in their city? Or that illegal aliens couldn’t rent a house? Or that Muslims couldn’t bang out their obnoxious calls to prayer all day long? She’d go nuclear. And you’d better believe that she’d want “some politician” from Austin or Washington “butting in”.

She then claims any bill addressing this stupidity will have no chance in the Texas House.

At times like these, we should all bow our heads and say a prayer for Joe Straus, the Republican speaker of the Texas House, who will have to play the grownup once again next session in staving off legislation that would hurt Texans as well as the Texas economy.

The bill doesn’t have much of a chance in the House, which prompts the question: Why try?

Answer: So that a few far-right politicians can say they fought the good fight. And winning isn’t the point anyway.

“Defeat would perhaps be the desired outcome of some of these bill advocates,” says Rice University political scientist Mark Jones. “It would allow them to have their cake and eat it too.”

As a strong supporter of Speaker Straus, I can say this with confidence – he will not block a bill that addresses this. He will allow the will of the House to prevail. If enough House members want to pass this, it will pass. That is being an adult in the room. And as much as I like Mark, he is taking this issue much too lightly with a remark like that.

Incredibly, she somehow wraps this up and blames the rise of Trump on people opposing this nonsense. Talk about not understanding why Trump is where he is. It is precisely because politicians ignored idiotic policies like that that Trump is where he is.

Republicans should stand FIRM and reject this crap. And readers need to understand that columnists like Ms. Falkenberg are not trying to give them an unbiased view of the facts, they are paid to produce biased opinions that support the newspaper’s underlying philosophy. Fort Worth ISD Superintendent should resign

Hard to believe that a school district in Texas would push a policy that allows gender neutral restrooms. Lt. Gov. Dan Patrick is absolutely correct: Fort Worth ISD Superintendent Kent Scribner should resign or be fired. Immediately.

I am sick and tired of people pushing these idiotic policies down our throats. Just stop.

It’s Time to Stand With Fort Worth: No Men In Women’s Restrooms!
Superintendent Should Resign

During the last legislative session, we warned our legislators that failure to pass bills like HB1478, which would have kept men out of female restrooms, locker rooms, and shower rooms was necessary. We warned them that their failure to act would result in the same battle we fought in Houston being fought in every city and county in Texas. Recently, the Superintendent of the Fort Worth, Texas, Independent School District (ISD) unilaterally issued new transgender student guidelines at the Board of Trustees’ meeting dictating serious and dangerous new policies, effective immediately. The guidelines were not voted on, debate or discussed at any Board meetings.

According to Ann Hettinger, President of CWA, Texas, “These new guidelines (many of which may actually violate Texas state law) say employees of the district will undergo adverse employment action if they do not go along with all of the new guidelines that clearly violate not only common sense, but First Amendment speech and religious liberty rights. They can no longer use the words “boy” and “girl” and must abandon gender references, information about the students gender expression on campus will be withheld from parents, no medical or mental health diagnosis is required in order to have a student claim an identity and therefore, have full rights to the opposite sex locker rooms, bathrooms, etc. Click here to read the actual guidelines.”

The Fort Worth Independent School District is trying to deceive folks into believing the guidelines are in accordance with governing law, but there is no federal or state law on this. Title IX, which was written in 1972, states that you cannot discriminate based on sex (sex meant male or female) in order to receive federal funds. School districts are not required to make any transgender policy changes by Texas or Federal law, even if it is the desire of bureaucrats from the Department of Education to make up new definitions and set up interdepartmental guidelines without having any amendments to the law passed by Congress. As evidenced by what is happening in North Carolina, the Department of Education Office of Civil Rights is bullying school districts into believing they have no choice but to make these policy changes as is currently happening in Chicago, Illinois. Click here to read more about that situation.

If you live in the Fort Worth area, please attend the Fort Worth ISD School Board meeting on Tuesday, May 10, 2016, at 5:30 p.m. to be held in the Board of Education complex at 2903 Shotts Street, Fort Worth, TX 76107.

Email each member of the Fort Worth ISD Board and respectfully express your concerns. Even if you don’t live in the Fort Worth school district, this sets a dangerous precedent and they need to hear from all Texans.

It is time for us to join Lt. Gov. Dan Patrick, and call for the resignation of Dr. Kent Paredes Scribner, Superintendent of the Fort Worth Independent School District. Governor Patrick is correct when he states: “After less than a year as superintendent, Dr. Scribner has lost his focus and thereby his ability to lead the Fort Worth ISD. He has placed his own personal political agenda ahead of the more than 86,000 students attending 146 schools in the district by unilaterally adopting ‘Transgender Student Guidelines.’ Without any discussion with parents, board members, principals, and other community leaders, Dr. Scribner’s unilateral action, underscores this lack of fitness to hold his position as superintendent. Campus safety should be of paramount concern for anyone in his position. Every parent, especially those of young girls, should be outraged. The State of Texas has an affirmative responsibility to provide a safe environment in the schools where attendance is compulsory. While this may be an example of the need for the Legislature to pass a meaningful School Choice Bill, we must not allow the actions of Dr. Scribner to go unnoticed or unanswered.”

I join Gov. Patrick in calling upon the parents within the Fort Worth ISD to take immediate steps to repeal this backwards policy and remove Dr. Scribner from his position.

It is time to take a stand! It is time to fight the good fight!

An Alternative way to Combat Abortion

Sometimes it’s good to take a step back and look at the big picture. Soon, the Supreme Court will issue their decision on HB2. This provides a good opportunity to take a look at the big picture regarding abortion.

Lots of time, energy, and downright vileness was spent in Austin when HB2 was debated and voted on. And while players may have made all the correct noises, they really didn’t want to hear their constituent’s (or donor’s/volunteer’s in the case of lobbying groups) opinions. Minds were closed, positions entrenched, and in reality the final outcome decided. Yes, a filibuster necessitated a special session, but the outcome was never in doubt. The bill was going to pass, and be challenged in Austin, and ultimately be decided at an appellate court level. The maneuvering and political theatre wasn’t directed at the outcome of the bill, but rather was directed at swaying public opinion (and in the case of the opposition to create a heckler’s veto.)

With the conclusion forgone something else is forgone also – the opportunity for meaningful change with the status quo lines of argumentation. Sure the fringes can be picked at, and sometimes the fringes can be substantial (should the ambulatory surgical center requirement be upheld as an example.) But it’s still picking at the edges, and won’t cause a meaningful change in the incidence of abortion.

If HB2 stands, the relative difficulty in having to travel to Houston, Dallas, Austin, or San Antonio (with a likely new regional center eventually opening up in Amarillo or Lubbock) might cause a downtick in incidence, but it’s not really changing the underlying fundamentals in the debate. It’s a decrease in convenience, not access, regardless of what the eight Justices decree. Hop in a your car, board a plane, ride the Greyhound, there’s plenty of access. A decrease in convenience isn’t going to make a significant change in incidence.

What will make a significant change is changing the underpinnings of the debate. The various right to life groups all serve different, but equally important, functions in addressing the underpinnings of the debate. For example, Texas Right to Life has a robust education and grass roots development program that serves to act as a counter to the pro abortion presence on colleges/universities. Save the Storks is literally in the trenches with their fleet of busses traveling to abortion centers providing an on the spot alternative. Crisis pregnancy centers provide tangible assistance as well as maintain referral networks to provide support for those in need.

These groups, in their own way, help to change the underpinnings of the debate by shifting the opinions regarding abortions to be more prolife. Polling shows that the portion of the population who believes abortion should be illegal in all circumstances is a distinct minority, topping out at 19{997ab4c1e65fa660c64e6dfea23d436a73c89d6254ad3ae72f887cf583448986} over time. The fluctuation in public opinion is between legal at all times versus legal only in certain circumstances.

Times were bleak for the prolife movement from 1989-1996, but the trends have come back to baseline. More telling is that of those who are dissatisfied with the current legal status on abortion the desire is for more restrictive laws, by about a 2:1 margin; and Planned Parenthood favorability has dropped by a quarter from 80{997ab4c1e65fa660c64e6dfea23d436a73c89d6254ad3ae72f887cf583448986} to 60{997ab4c1e65fa660c64e6dfea23d436a73c89d6254ad3ae72f887cf583448986} (in round numbers.) It’s reasonable to conclude that there’s an appetite for change, but the question is what direction should the prolife movement take to realize change?

Abortion clinics are closing in blue states as well as red states. In the blue states they are closing from purely economic reasons. The rate of closure is significant – two clinics close in a blue state for every three in a red state. This shows that the economic strain that comes with the overall decline in abortion rates is having a significant impact. This gives us the answer to the question.

Don’t try and legislate against abortion directly where strict scrutiny is the standard of review, but rather legislate in a manner to make prenatal care more profitable than abortions. This will be covered by a rational relationship test since you are dealing with health and safety regulation that doesn’t directly impact abortion. Although medical providers may argue that women should have access to abortion how many have strong, principled, convictions towards abortion? The answer is likely not many unless they are directly providing abortions. If prenatal care becomes more economically profitable for providers the rate of referral for abortions declines. Rather than abortion being a choice, it’s a procedure to avoid since prenatal care is more profitable. This over time lowers the incidence of abortion, and clinics who are struggling to stay afloat will close for economic reasons

Harris County DA Devon Anderson has a problem with free speech

So you’re the District Attorney of the largest county in Texas. Big job. Lots and lots to do putting murderers on death row, solving rape cases, thwarting drug cartels, etc. Unless you happen to be the current occupant of the job, Devon Anderson. If you are Harris County District Attorney Devon Anderson, you spend your time trying to shut down a fellow Republican scheduled to speak at a Harris County Republican Club.

Hey, what can I say? Truth is stranger than fiction.

Fellow BJP contributor Don Hooper was asked to speak at the Daughters of Liberty’s April meeting about the pro-life issue. In case you don’t know, that issue is the driving issue for Don’s political involvement through the years. So, naturally, he accepted.

Oh my, you would have thought that the DOL asked Hillary Clinton to speak the way DA Anderson reacted. First her consultant, an associate at Blakemore and Associates, tried to get the club president, Bonnie Lugo, to rescind the invitation. When that didn’t work, Ms. Anderson’s sister-in-law tried to get Ms. Lugo to rescind the invitation. When that didn’t work, DA Anderson herself stepped in and tried to pressure Ms. Lugo into rescinding the invitation via email and voicemail (which I’ve seen and heard). When her pressure on Ms. Lugo didn’t work, DA Anderson went so far as to send emails to the members and directors of the DOL critical of Ms. Lugo’s decision to invite Hooper and threatening to have the Texas Federation of Republican Women revoke the DOL’s status as an auxiliary. You know, throw a little elected official weight around.

It almost worked. A couple of members of the DOL board bought into DA Anderson’s story and went so far as to call a board meeting to try and overturn the invite.

A funny thing happened during that meeting.

Ms. Lugo laid out the cards and it turns out that the Daughters of Liberty’s board decided they wanted to hear what Hooper had to say. They went so far as to send a letter to their members about it:

DA Anderson made inaccurate statements about Hooper’s invitation and provided “evidence” that didn’t add up? Say it ain’t so!!

But, honestly, it sounds typical of the Harris County DA’s office under Anderson’s direction, doesn’t it?

You know, like colluding with Planned Parenthood to charge a couple of do-gooders who were trying to expose the horrific trade in aborted baby’s body parts? Instead of, you know, presenting evidence to the grand jury about the horrific practices that the do-gooders exposed?

Truth is, DA Anderson doesn’t like Hooper because he occasionally writes things about her that are true. Uncomfortable but true. Damaging to her ego but true. Things she’d rather not have the public know about but true. Notice the common denominator – truth.

If I were you and wanted to know why DA Anderson tried to bully the women of the Daughters of Liberty, I’d go to Thursday night’s meeting and see what Hooper has to say. Whatever it is, it will be true.

And that, apparently, won’t go well for DA Anderson.
