Good news! The indictment against Center for Medical Progress founder David Daleidan was dismissed!
The Center for Medical Progress statement along with a copy of the dismissal can be found here.
Kudos to Judge Bull for following the law and dismissing the indictment.
Bad news – the indictment was dismissed for technical reasons, specifically “[t]he indictment’s failure [to address a technical legal point] renders is void. A void indictment confers no jurisdiction to this court.” A very technically sound dismissal, but one that is easily cured.
This leaves the district attorney’s office two options: 1) let the case go 2) cure the technical defect and indict again without the technical error. Make no mistake, this is gut check time for Devon Anderson. Either course will have political impact and sway votes come November leaving the issue simply a matter of what does she believe should happen.
To indict or not to indict that is the question….

Looks like the other indictment will be dismissed also, as the people selling body parts as skating scott free…..WHY? Is this not like the other case with the abortionist a couple of years back? Will this pave the way for a major loss in November?

They have said no appeal — will this mean no re-filing, too?

The fact that DA Anderson allowed these charges to get this far is the real issue. The judge dropping Daleidan and Merritt’s charges due to a technically is a blessing, but doesn’t change the bigger issues that they were charged in a very underhanded manner, a Grand Jury that didn’t even vote on the unsavory charges against Planned Parenthood that brought this case before them in the first place, and a DA that has allowed this farce to move forward. Daleidan and Merritt are heroes. DA Anderson and her office are a grave disappointment to pro-lifers. This was a convenient decision for the DA to try to erase the reasons for Patriots to rise up against Devon Anderson’s pro-abortion action. While this is somewhat good news, Daleidan and Merritt still need our prayers because getting off on a technicality is really not good enough and there are still charges against them. The timeline of this entire scenario is still very disturbing and needs to be remembered at election time.
