Harris County court documents show HCC trustee-elect Dave Wilson filed a temporary restraining order against HCC Trustees Bruce Austin, Sandie Mullins etal on December 9th, 2013. According to the temporary restraining order and order to appear filed in the 334th District Court, Wilson sought to order HCC to maintain and not destroy election records related to the recent HCC Trustee race.
From the TRO:
“On this day, this court reviewed David B. Wilson’s Original Petition and Request for a Temporary Injunction with its attachments. David B. Wilson’s pleadings and affidavit clearly show the potential for irreparable harm if this Court does not enter a temporary restraining order. Further, Wilson has demonstrated that, as a matter of law, all election records are to be kept and maintained.
It is ORDERED that Sandie Mullins, Bruce Austin, Dianne Johnson, Neeta Sane, Christopher W. Oliver, Yolanda N. Flores, Herlinda Garcia, Carroll G. Robinson and Eva Loredo are hereby enjoined from altering, modifying, or destroying any document, ballot, report, email or other tangible thing relating to:
a. The election for HCC Board of Trustees for District II:…….”
As a result, on December 17th, during a Special HCC Board meeting, the election results were canvassed, Wilson was declared the winner of the HCC District II race and a certificate of election was issued.
Cause number 2013-73563 was then denied.
